Terms of Service

1. Agreement

By accessing or using Recoverly, you agree to these Terms of Service. If you do not agree, do not use the service.

2. The service

Recoverly automatically responds to missed inbound calls to your business phone number with an SMS message and optional follow-ups. You are responsible for the accuracy of the phone number, business information, and message templates you configure.

3. Fees

Recoverly is billed as a one-time setup fee of $500 and a recurring monthly service fee based on your selected plan (starting at $300/month), plus applicable per-minute and per-text usage charges beyond your plan's included amounts, unless a separate written agreement applies. Fees are non-refundable except where required by law.

4. Acceptable use

You agree not to use Recoverly to send unlawful, harassing, or unsolicited marketing messages, and to comply with all applicable laws including the TCPA and CAN-SPAM Act. You are responsible for obtaining any required consent from message recipients.

5. Automated Messages Are Transactional-Only

The SMS messages Recoverly sends on your behalf in response to missed calls are transactional in nature — confirming receipt of a call, gathering job details, and coordinating an appointment. They are not marketing or promotional messages. You agree not to use Recoverly's messaging templates to send promotional, marketing, or unsolicited content to end customers. Any such use is a violation of these Terms and may result in suspension of your account.

6. Termination

Either party may cancel the service at any time. Upon cancellation, automated replies will stop at the end of your current billing period.

7. Disclaimer

Recoverly is provided "as is" without warranties of any kind. We do not guarantee that every missed call will result in a recovered booking or that the service will be uninterrupted or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, Recoverly's total liability arising from the service is limited to the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Recoverly, its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the service; (b) your violation of these Terms or any applicable law, including the TCPA and CAN-SPAM Act; (c) the accuracy of the phone numbers, business information, or message content you provide or approve; or (d) any claim brought by an end customer arising from messages sent on your behalf based on the configuration, consent records, or instructions you provided.
